Promotional Period 

  1. The Promoter of this promotion is Woolworths New Zealand Limited, 80 Favona Road, Auckland (“Promoter”). The provider of the prize for this promotion is Heinz Wattie’s Limited(“Prize Provider”).

  1. The promotion commences at 00.01am on 26 April 2021 and closes 11.59pm on 2 May 2021 (“Promotional Period”). 

  1. This promotion is open to New Zealand residents aged 18 years or older. Please note that employees of the Promoter and the Prize Provider cannot be excluded from Onecard promotions, including this promotion.

  1. Entrants must:

    1. have a register Onecard;

    2. have a New Zealand bank account in their name; and

    3. be able to attend (or nominate a suitable proxy, who is 18 years or older, to attend) the Main Event (as defined below).

  

Method of Entry

  1.  Customers can enter the promotion, during the Promotional Period by:

    1. purchasing any five or more Wattie’s® products in one transaction (“Qualifying Purchase”) either in store or online from a Countdown supermarket (excluding Metro stores) owned by the Promoter (“Countdown”); and 

    2. either swiping their registered Onecard or entering their registered Onecard details at the time of purchase.

 

  1. Entry is limited to one entry per transaction. Entry date for online purchases is the order delivery date (which must be within the Promotional Period). For the avoidance of doubt, customers will not be eligible to participate in this promotion if they do not swipe or enter their Onecard details at the time of purchase.  Entries will not be accepted on a retrospective basis after the time of purchase. 

  1. Entrants must retain a purchase receipt for each Qualifying Purchase as proof of purchase.

  1. Entrants must ensure their Onecard is registered with complete and up to date account details (including phone number).

  1. The Promoter may verify the validity of entries and may disqualify entries that do not comply with these terms and conditions. 

  1. The Promoter reserves the right, at its discretion, to remove or to introduce further products from the “Qualifying Purchase” during the Promotional Period. 

 

Winner

  1. One (1) prize winner will be determined by a random electronic draw from all valid entries received in the promotion on 17 May 2021. The draw will be conducted by the Promoter.

  1. The first valid entry drawn by random electronic draw will be invited to attend the Main Event. There will be one winner only.  

  1. The Prize Provider, on behalf of the Promoter, will contact the winner. The winner will be notified by telephone and/or email using the details listed on the Onecard database.  If the Prize Provider is unable to reach the winner by telephone or email, the Prize Provider will send the winner a letter notifying them.  It is up to entrants to ensure that their relevant details on the Onecard database are correct.  Details can be updated via the website www.countdown.co.nz/onecard or by phoning the Countdown Customer Care team on 0800 40 40 40.

  1. In the event a winner cannot be contacted, (that is, cannot be reached by telephone and/or does not respond to email) within three (3) business days of the prize draw, the Prize Provider will send the winner a letter giving a further two (2) weeks from the date of the letter to get in touch with the Prize Provider.  If there is no response, another winner will be drawn on the same terms as the original draw. This process will continue until the Prize Provider is able to contact a winner. The Prize Provider on behalf of the Promoter, may require the winner to submit a photograph of their proof of purchase for verification purposes. 

  1. The winner must be available to attend the Main Event in person. The winner may appoint a proxy over 18 years of age to attend and participate in the Main Event on their behalf provided the winner gives the Promoter enough written notice prior to the Main Event.  In the event that a nominated proxy participates in the Main Event on the winner’s behalf, the winner agrees to accept all decisions made by the nominated proxy and no correspondence will be entered into. 

  1. The winners will have their details published on the Countdown website for 2 weeks following the draw date.  By accepting the Prize, each winner consents to his or her name and/or photograph being used for such publicity purposes as reasonably determined by the Promoter. The winners agree to make themselves reasonably available for this purpose, without compensation. 

 

Prize and Main Event 

  1. The winner wins their chance to attend a ‘Wattie’s® Chance to Win a Million Dollars’ event (Main Event).

  1. The Main Event will be held at the Prize Provider’s Head Office (Level 3, 2 Nuffield Street, Newmarket, Auckland). Upon discussion with the Promoter, the winner may invite 1 guest to the Main Event, subject to any COVID 19 restrictions.  

  2. At the Main Event, the winner will be presented with 100 envelopes numbered from 1 to 100. The envelopes will randomly contain a predetermined message as follows:

  1. One (1) envelope will contain a message stating that it represents a NZ$1,000,000 prize (Major Prize). 

  2. The other ninety-nine (99) envelopes will contain a message stating that they represent a NZ$10,000 prize (Minor Prize).

  1. The winner may select one envelope without touching, handling or interfering in any way with any of the other envelopes on display. The winner will have one chance to select an envelope (Selection Process).

  2. The Selection Process will be monitored by an independent supervisor “loss adjustor” appointed by the underwriter of the Major Prize and their instructions must be followed at all times. 

  3. The message contained in the envelope selected by the winner will determine their prize, in accordance with the amount stated in the message (being either NZ$1,000,000 or NZ$10,000). The Selection Process will be conducted once only and will not be repeated. 

  4. If the winner selects an envelope containing the Minor Prize, the Promoter or Prize Provider will locate and open an envelope containing the Major Prize. The Promoter will open that envelope to confirm its contents to the winner and the independent supervisor. 

  5. No additional envelopes may be opened by the winner. 

  6. The Main Event (including the Selection Process) will be videotaped for verification and marketing purposes.

  7. The Prize will be delivered to the winner by way of an electronic funds transfer to the winner’s nominated New Zealand bank account within 30 days after the Main Event. It is the winner’s responsibility to ensure that the correct New Zealand bank account number is provided to the Promoter or its nominated agent for the purpose of the transfer.

  8. The Main Event must take place within 1 month of the end of the Promotional Period. If, despite reasonable efforts by the Promoter, the winner or their nominated proxy is unable for any reason to attend the Main Event within 1 month of the end of the Promotional Period, then the winner will forfeit their chance to participate in Main Event and another winner may be drawn on the same terms and conditions as the original invitation draw.

 

Travel to the Main Event 

  1. If the winner resides in Auckland, they will be provided with:

    1. 2 nights’ 4 star accommodation for 2 adults in 1 room; and

    2. taxi transfers to and from their hotel to the Main Event. 

 

  1. If the winner resides outside of Auckland, they will be provided with:     

  1. return economy flights for the winner and their guest from the winner’s closest NZ regional airport to Auckland; 

  2. airport transfers in Auckland only; 

  3. 2 nights’ 4 star accommodation for 2 adults in 1 room; and

  4. taxi transfers to and from their hotel to the Main Event.

 

  1. Any travel provided must be taken on the dates specified by the Prize Provider and Promoter to coincide with the Main Event. The winner and any travelling companion are responsible for ensuring they have all necessary travel insurance and documents to travel if required.  Any changes to travel or additional accommodation outside the travel period must be approved in advance by the Prize Provider and Promoter and will be at the expense of the winner (or nominated proxy) and any travelling companion as incurred.  Neither the Prize Provider nor the Promoter are responsible for the cancellation, delay or rescheduling of any part of the travel component and any costs incurred by the winner or any travelling companion as a result (including accommodation costs) will be the responsibility of the winner.  The winner (or their proxy if applicable) is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunisations and/or health checks prior to travelling.

  2. Unless otherwise specified, the air travel is economy class.  The winner and any travelling companion(s) must depart and return at the same time using the same air carrier. The winner (or nominated proxy) and their guest will be responsible for ancillary expenses including, but not limited to, spending money, luggage costs, meals, drinks, transport, laundry charges, activities, incidentals, insurance (including excesses), taxes (excluding departure and any other flight associated taxes. The winner may be required to present their credit card at time of accommodation check in. 

  3. The winner (or nominated proxy) and their guest must obtain, at their own expense, travel insurance to protect themselves and their travel companions against additional costs incurred in the event of unforeseen circumstances. If the winner and their travel companions do not present proof of travel insurance to the Prize Provider and Promoter prior to travel, the Prize Provider and Promoter may require the winner and their travel companions to sign a waiver of liability.

  4. The Promoter may be required to reschedule the Main Event due to COVID 19 government restrictions.  If this is to occur, the Promoter will provide the winner with the rescheduled time and the flight itinerary may have to be adjusted. If any element of the promotion (including the Main Event) is not capable of running as planned due to official COVID-19 Government restrictions, the Promoter and Prize Provider may, at their sole discretion, use reasonable endeavours to award the Major Prize by alternative means, this may include holding a virtual Main Event by video conference or a change to the Main Event date.  All decisions relating to changes to the promotion and Main Event due to COVID-19 restrictions are at the sole discretion of the Promoter and Prize Provider and no correspondence will be entered into.

  5. If the trip can be safely taken based on government travel advice, and the winner elects not to travel for the Main Event, they will forfeit the travel component of the prize and no substitute will be offered.  For the avoidance of doubt, if the winner or their proxy (and guest) are, for whatever reason, unable to travel on the nominated date, whether the failure was due to reasons beyond the winner’s control or otherwise (unless due to official COVID-19 related restrictions), and they can’t attend the Main Event virtually with a representative of the Promoter and the Prize Provider, then the winner will forfeit the Major Prize.

  6. The Promoter and the Prize Provider make no representation as to safety, conditions and other issues that may exist at any destination and the winner should seek their own travel advice. The winner accepts the Major Prize or Minor Prize (as applicable) and all travel associated with attending the Main Event, at their own risk. 

  7. All travel is subject to these terms and conditions. Any travelling companion accepts these terms, conditions and restrictions as if references to the winner in the relevant clauses were to the travelling companion.

 

Exclusions and Liability

  1. The Promoter will not be responsible for any late, lost or misdirected entries, including but not limited to entries not received due to technical problems.

  1. The Promoter is not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction associated with the promotion.

  2. Except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), the Promoter (including its directors, officers, employees and agents), the Prize Provider and their affiliates and corporate partners exclude all liability for any loss, damage, personal injury or death, whether direct, indirect, special or consequential, arising out of or in connection with the promotion, including, but not limited to, where arising out of the following: any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; any tax liability incurred by the winner or entrant; or any prize or participation in, acceptance or use of any prize.

  3. The Promoter and the Prize Provider accept no responsibility for any tax implication that may arise from the prize winnings.  The winner must seek independent financial advice on the taxation implications of the receipt or use of any prize.

 

Use of Personal Information

  1. All entries remain the property of the Promoter.  All personal information will be collected and stored by the Promoter and the Prize Provider in accordance with the Privacy Act 2020and their respective privacy policies.   1. The Promoter may use entrants’ personal information from entries to conduct the promotion and for its own future promotional and publicity purposes, in accordance with standard Onecard Terms and Conditions.  These terms and conditions are available to view at www.countdown.co.nz.  Entrants consent to the Promoter passing on their contact details to the Prize Provider and/or the Prize Provider’s agency for the purposes of notifying the winner, facilitating the Main Event and any other purpose required to conduct this promotion  and otherwise in accordance with entrants’ consent and applicable privacy laws.  

  1. By entering this promotion, entrants consent to the use of their information as described above.

 

General Terms and Conditions

  1. The promotion will be conducted by the Promoter in accordance with these terms and conditions.To the extent that any matter relating to the promotion is not covered by these terms and conditions, the Promoter reserves the right in its sole discretion to conduct the promotion as it sees fit, subject to any legal requirements. 

  2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, place of residence and proof of purchase). Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter.

  3. The Promoter reserves the right to disqualify any entrant or refuse to award a prize where it has reason to believe any entrant has breached any of these terms and conditions including failing to provide proof of purchase, or engaged in any unlawful, dishonest or other improper misconduct calculated to jeopardise the fair and proper conduct of this promotion. The Promoter and the Prize Provider’s legal rights are reserved, including the right to recover damages or other compensation arising from such conduct. The Promoter’s decision is final. 

  4. If requested by the Promoter, the winner (and their companion (if applicable)) must participate in all reasonable promotional activity (such as publicity and photography) surrounding this promotion or their winning of a prize, free of charge. The winner (and their companion (if applicable)) consent       to the Promoter, the Prize Provider and their affiliates and agencies to use their names and images in promotional material.

  5. The Promoter and its associated agencies and companies and the Prize Provider and its affiliates and agencies involved in this promotion, take no responsibility for prizes damaged or lost in transit. The Promoter will not be responsible for any delay or failure to deliver, or damage caused to any prize during transit.

  6. All decisions of the Promoter are final and no discussions or correspondence will be entered into. 

  7. Failure by the Promoter to enforce any of their rights under these terms and conditions at any stage does not constitute a waiver of those rights.

  8. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of any prize or the Main Event if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate or attend the Main Event. 

  9. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion and to the full extent permitted by law, to vary, suspend or cancel this promotion.

  10. By participating in this promotion, entrants grant a perpetual worldwide non-exclusive royalty-free licence to the Promoter to use and sub-licence the use of any copyright (including future copyright) in and to any entry submitted. To the extent that an entrant has any moral rights in their entry, the entrant hereby provides consent for the Promoter and its licensees to do any act or omission that would otherwise infringe that entrant’s moral rights.  Each entrant warrants to the Promoter that his or her entry does not infringe the intellectual property rights of any person.
