Countdown eGift Card Terms and Conditions

TERMS AND CONDITIONS:

  1. Definitions
    1. In the terms and conditions:
      "Card Balance" means the unspent value of a Countdown eGift card.
      "Card Number" means the 19-digit number that appears on the Countdown eGift card.
      "Countdown eGift card" means an eGift card issued by Countdown.
      "Countdown store" means any Countdown supermarket.
      "Passcode (PIN)" means the 4-digit number on the Countdown eGift card which is required to make a transaction.
      "redeem" means to reduce the value loaded on your Countdown eGift card by using the Countdown gift card to purchase goods or services at a Countdown store.
    2. A reference to "we", "us" or "our" is a reference to Woolworths New Zealand Limited or, where applicable, another entity within the Woolworths New Zealand group.
    3. A reference to "you" or "your” is a reference to the person who is taken to agree to these terms and conditions under paragraph 2.
  2. Agreeing to these terms and conditions
    1. These terms and conditions apply to each Countdown eGift card.
    2. You agree to be bound by these terms and conditions by activating, using, or attempting to use a Countdown eGift card or exercising any right to redeem value loaded on a Countdown eGift card.
    3. By activating, using or attempting to use a Countdown eGift card, or exercising any right to redeem value loaded on a Countdown eGift card, you warrant to us that you will comply with these terms and conditions and all applicable laws and that the Countdown eGift card will not be used in any manner that is contrary to these terms and conditions or that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.
    4. If you are giving a Countdown eGift card to another person, you should ensure that he or she is aware of these terms and conditions that apply to the Countdown eGift card.
  3. Redeeming your Countdown eGift card
    1. Your Countdown eGift card can be redeemed for goods and services from Countdown stores up to the value loaded onto your Countdown eGift card. Value redeemed is deducted from the card balance. Your Countdown eGift Card cannot be redeemed for online purchases.
    2. Countdown eGift cards cannot be used at stand alone Lotto counters or terminals.
    3. Countdown eGift cards cannot be refunded, redeemed for cash or used to obtain cash. Resale of Countdown eGift cards is strictly prohibited, except with our prior written consent. If approved, eGift cards cannot be resold for more than the unspent value of the Countdown eGift card. Countdown eGift cards that are resold in breach of this paragraph 4(iii) will be invalid with the result that purchasers of those cards will not be able to use or redeem unspent value on their Countdown eGift cards.
    4. Your use of the Countdown eGift card at a Countdown store is subject at all times to the policies (and, where applicable, other terms and conditions) of that Countdown store regarding the goods and services made available by it and to compliance with the law.
    5. Where the price of the goods or services being purchased with the Countdown eGift card exceeds the card balance, you must pay the amount exceeding the card balance by an alternative payment method at the discretion of the relevant Countdown store.
    6. Countdown eGift cards do not have an expiry date and may be redeemed at any time.
    7. Once your Countdown eGift card has reached a nil balance, it cannot be re-activated.
    8. The redemption of Countdown eGift cards is restricted to the purchase of standard retail quantities of goods.
  4. No recharging of the Countdown gift card
    1. After a Countdown eGift card has been activated, you cannot subsequently add value to it.
  5. Lost or stolen Countdown eGift cards
    1. You must treat your Countdown eGift card like cash. If your Countdown eGift card is lost, deleted or stolen, please contact us on 0800 40 40 40. However, we have no obligation to replace or refund the value for lost, deleted or stolen Countdown eGift cards.
    2. We reserve the right to place a stop on your Countdown eGift card if:
          a) you report that your Countdown eGift card has been lost, deleted or stolen; or
          b) we believe (or reasonably suspect) that you have used (or will use) your Countdown eGift card contrary to these terms and conditions or any applicable laws.
  6. Liability
    1. You are responsible for the use and safety of your Countdown eGift card, and are liable for all transactions made on your Countdown eGift card.
    2. Subject at all times to the exceptions in paragraph 6(iii), we are not liable to you for any loss or damage (whether direct, indirect, consequential or special) either in negligence, other tort, breach of contract, breach of warranty or for any other reason or cause whatsoever, arising out of or in connection with a Countdown eGift card, these terms and conditions including any loss or corruption of data, interference with or damage to your computer or any interruption, delay or failure in the website.
    3. The exclusion of our liability in paragraph 6(ii) only applies to the extent permitted by law. Where consumer protection legislation implies any condition or warranty that cannot be excluded in these terms and conditions, we limit our liability for breach of any such implied conditions or warranties to the re-supply of the services (or costs thereof). Any liability we have to you will be reduced by the extent (if any) to which you caused or contributed to the loss or damage. This paragraph 6 will apply even after this agreement has ended.
  7. Relationship with Woolworths New Zealand Limited.
    1. Countdown eGift cards may be used as personal or business gifts, but must not be used in connection with any marketing, advertising or other promotional activities (including without limitation in websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval. Countdown eGift cards that are used in marketing, advertising or other promotional activities in breach of this paragraph 7(i) will be invalid with the result that recipients of those cards will not be able to use or redeem unspent value on their Countdown eGift cards.
    2. Use of our name or brands, or any names, logos or get-up of Countdown eGift cards (other than in connection with the use of Countdown eGift cards), is strictly prohibited.
    3. You must not use a Countdown eGift card in any manner that states or implies that any person, website, business or product or service is endorsed or sponsored by or otherwise affiliated with us or any of our subsidiaries or affiliates. 
    4. We may change these terms and conditions from time to time. We will endeavour to give you reasonable notice of the change by publishing our updated terms and conditions here and/or by other communication methods we adopt from time to time. Your use of an eGift Card after the terms and conditions have been changed indicates your acceptance of those changes. 
  8. Privacy
    1. We collect, use, share and store your personal information when you interact with us. Please see our privacy policy which explains how we manage your personal information.
    2. We use your information to provide or improve our services, and we may use it for marketing sent by us or our partners.  Sometimes we may need to share your information with programme and marketing partners, but we always take steps to protect your information. Details on how you can opt-out are set out in our Privacy Policy.
